UNIFICACIÓN DEL POS: UNA TARDÍA SOLUCIÓN QUE AFECTA LA EQUIDAD EN SALUD Y AHONDA LA PROBLEMÁTICA DEL SGSSS

El artículo describe el tortuoso recorrido normativo que se dio para cumplir con lo establecido en la ley 100 de 1993, en lo referente a la unificación de los contenidos de los planes de beneficios en salud de los regímenes contributivo y subsidiado.
La tardía unificación favoreció la inequidad en salud, dificultó el acceso real a los servicios y deterioró algunos indicadores de salud pública, conllevando, a que los ciudadanos utilizaran la Tutela como medio para garantizar este derecho fundamental; lo que produjo un incremento de las atenciones de alto costo recobradas al Fondo de Solidaridad y Garantía (FOSYGA).
Ante esta problemática, la Corte Constitucional mediante la sentencia T-760/2008, impele al gobierno nacional a unificar los contenidos de los planes, como un camino para lograr la equidad en el sistema de salud. Sin embargo, esta tardanza se constituyó en un factor causante de la crisis del sistema.
