Los derechos de propiedad intelectual (DPI) constituyen una institución económica1 que ha evolucionado en el tiempo, a la par con el avance del conocimiento científico y tecnológico2. La biotecnología, tan antigua como el hombre mismo, también ha evolucionado de acuerdo con los desarrollos del conocimiento humano que han buscado manipular la naturaleza en su provecho. Unos y otra no siempre han estado relacionados y más bien por el contrario, en diferentes épocas se ha evitado conscientemente su encuentro. Sin embargo, en tiempos recientes las dos trayectorias han convergido, dando origen a debates en torno a qué tan justificada está la aplicación de la institución sobre la ciencia y también sobre la conveniencia de hacerlo.
En esta nota se pasa revista a esa relación y la manera como se ha precipitado en las últimas décadas. Finalmente se avanza una consideración sobre DPI, biotecnología y desarrollo.
