La imposición de límites sustantivos, no meramente procedimentales, a las reformas constitucionales puede considerarse como un caso agravado de la tensión entre la democracia y el constitucionalismo. Este artículo muestra que esos límites son hoy una tendencia global del constitucionalismo contemporáneo. Con base en un análisis comparado, se presenta evidencia y argumentos que contradicen la tesis de Melissa Schwartzberg, según la cual los límites sustantivos no son coherentes con el ideario democrático. No obstante, ese mismo examen sirve para dar cuenta de la indeterminación del contenido de esos límites y de la extraordinaria discreción del poder judicial al interpretarlos. A modo de conclusión, se presenta una tesis acerca del papel de la ciudadanía en la defensa de la constitución basada en una lectura mayoritaria de la democracia.

The substantive limits imposed, not merely procedural, constitutional reforms can be considered an aggravated case of the tension between democracy and constitutionalism. This paper shows that these limits are now a global trend of contemporary constitutionalism. Based on a comparative analysis, we present evidence and arguments that contradict the thesis of Melissa Schwartzberg, under which the substantive limits are not consistent with democratic ideals. However, the same test to account for the uncertainty of the content of these limits and the extraordinary discretion of the judiciary to interpret them. In conclusion, we present a thesis about the role of citizens in the defense of the constitution based on a reading majority democracy.
