En este texto se establece de manera clara la proscripción a toda forma de enjuiciamiento secreto u oculto. Se reúnen en el grueso de este trabajo un conjunto de garantías constitucionales que protegen directamente al ciudadano de abuso o extralimitaciones del Estado. Se hará emerger los garantismos en favor de las personas y como carga para el Estado, ratificando el derecho de libertad y las precisas maneras como puede suspenderse éste derecho, y recuperarse. Se relacionarán garantías del proceso como el debido proceso, el principio de legalidad, la favorabilidad, el derecho de defensa y la presunción de inocencia
