En este artículo se intenta rebatir aquella imagen mítica de la historia del derecho del siglo XIX, según la cual la Paz de Westfalia de 1648 fue el punto de partida del derecho internacional público de la época postilustrada. En lugar de defender esa tesis, aquí se muestra cómo la Paz de Westfalia estaba todavía anclada en estructuras jurídicas y políticas de la antigua Cristiandad europea, que existió en el milenio entre la coronación de Carlomagno en 800 y su caída en la revolución francesa de 1789 respectivamente en la disolución del Sacro Imperio Romano en 1806.
