DEMOCRATIC JUSTICE OR ALTERNATIVE USE OF LAW

RESUMEN: En el presente artículo se analiza la corriente denominada Uso Alternativo del Derecho, que surge como una opción ideológica para el desligamiento total de la norma jurídica existente. El artículo fue llevado a cabo a través del método deductivo, es de tipo descriptivo, documental, observacional y no experimental, partiendo del estudio de la evolución en el tiempo de este pensamiento que comenzó como oposición a las instituciones tradicionales del Estado para brindarle a los menos favorecidos la posibilidad de defender sus intereses que ya se encontraban vulnerados. Luego de analizar las diferentes posturas en las diferentes regiones del mundo y especialmente la visión latinoamericana que se tiene sobre este concepto, se llega a la conclusión que tales ideas más que cambio en la estructura jurídica de los Estados, es el tinte político – izquierdista que se encuentra impregnado en ella, por tanto, se hace un llamado a la cordura y a la reflexión para ser neutrales y así poder identificar las fallas del sistema sin entrar en pasiones ideológicas.

This article examines the current so-called Alternative Use of Law, which emerges as an ideological option for the total disengagement of the existing legal standard. The article was carried out through the deductive method, it is of a descriptive type, documentary, observational and non-experimental, beginning with the study of the evolution in time of this thinking current that began as opposition to the State traditional institutions, in order to offer the least favoured the possibility of defending their already violated rights. After analyzing the different positions in different regions of the world and especially the Latin American vision about this concept, arises the conclusion that such ideas, more than a change in the legal structure of the States, is the leftist-political tint imprinted on it, and therefore a call to sanity and reflection is made as to become neutral, and in turn, be able to identify the shortcomings of the system without entering into ideological passions.
